The General Conditions of Sale apply to the sale of products with exclusive reference to purchases that are compliant with the provisions of the Consumer Code by:

Before placing an order, the user reads these General Terms and Conditions of Sale, which are generally and unequivocally accepted at the time of purchase.
Mat.en srl reserves the right to change the terms unilaterally and without notice.
Any present prices are expressed in EURO excluding IVA 22%.

Quotations
Our commercial quotations are valid for a period of 30 days from the date of issue, unless otherwise stated. Any variations must be agreed with us and communicated. In case of order confirmation, what is expressly specified in the quotation will be considered valid, so please always check all data (technical details of the offer, commercial conditions, master data, etc.) as best you can.

Graphic Drafts
No fees will be charged for the first graphic draft if the file is provided in vector or pdf format. Subsequent changes to the draft, or processing time for graphics because of non-conforming formats or if the design needs to be retraced, may include a charge for additional costs. In this case it will be our care to inform the customer and proceed only with prior acceptance of the same. In any case, the drafts are considered purely indicative.

Order modalities
The order will be confirmed only after signed and stamped acceptance of the quote. The order is not considered valid if the master data are incomplete, there are discrepancies between order and offer or, in the case of a request for payment to the order, it has not been received yet. Orders can be requested by e-mail to our main address: info@mat-en.com.

Order modification
The order can be cancelled and modified only if the production of the order has not yet started (it’s possible to cancel an order up to a maximum of 8h after placing it).
The user who wishes to cancel an order must notify it to Mat.en through explicit request by contacting us at the official email address info@mat-en.com.
If the production is in progress then it will no longer be possible to either modify or cancel the order on the basis of art. 59, letter c) of the Italian Consumer Code, which eliminates the right of recess in cases where the good sold has been made “to measure” or “customized” according to the choices of the customer.
Orders that have already been produced will be charged 100% of the value of the items.
For orders in process, never less than 50% of the value of the items will be charged to the customer.
When the conditions are compied and the cancellation is possible, Mat.en will then refund the amount within 15 working days.
In case EXPRESS shipping service was requested, cancellation and modification will no longer be possible after already confirming the order.

Terms of delivery
Indicative delivery terms are communicated in our quotation or offer and refer to the specific product at the precise time the offer is processed and sent. Our offices are available during opening hours for information on this matter. We do not accept claims for delays on delivery attributable to the forwarder or in any case, delays less than 5 (five) working days with respect to the expected delivery time communicated.

Delivery by courier
MAT.EN organize the transport of goods by national or international forwarder, but is free from any claims about late delivery or damage to the goods attributable to the courier.
If the goods appear damaged on delivery, it’s necessary to specify that at the time of delivery from the courier in DDT and / or on any delivery document of the forwarder, otherwise it won’t be possible to accept complaints. Any costs of storage or services like delivery to the floors, telephone notice, etc.. may be charged to the customer.

Mat.en offers the possibility of pickup on site either by courier arranged by the customer or by the customer himself. In this case will be charged only the costs provided for the packaging of the goods and the customer is required to pick them up within 5 working days from the notification of goods ready (beyond this date may be charged costs for storage, the goods may be deleted or held free and will not be provided for any our responsibility for damages). Different pickup schedules may be agreed in advance.

Delivered goods, defects or complaints
The customer has to check the correspondence between the material ordered and received, and if there are any obvious defects or non-conformities of the delivered goods within the period of 5 days from the delibery and to report them immediately to the company by e-mail to info@mat-en.com. No claims will be accepted on goods even temporarily used, laid or tampered by the customer. A WARRANTY right of 60 (sixty) days (the date of the D.D.T. or invoice will be decisive) is also recognized for manufacturing defects that become apparent with time (provided that the customer has and done proper maintenance).

Payments
Payment terms are indicated in the commercial quotation or order confirmation and are considered absolutely binding. Any delay, even the slightest, will result in a default notice and, after an initial informal written reminder, the initiation of debt collection by ASSICOM, the company in charge of these matter.

Applicable Law
These General Conditions of Sale are governed by and interpreted in accordance with Italian law.
The place of jurisdiction for any dispute is the Court of Brescia.
